SUBJECT: LP Gas Board Meeting
An LP Gas Board meeting has been scheduled for Friday, March 16, 2012 at 10 A.M., at the Murray City Hall, Council Chambers, 5025 South State Street, Murray, Utah, 84107.
The agenda for the Board meeting will be as follows:
Board meeting called to order and welcome to all by Acting Chairman Tom J. Clark.
Approval of the minutes of the October 14, 2011 Board meeting.
Election of new Board Chair and Vice Chair from the Board Members. This required to at the first meeting of the year.
Introduction to the Board by State Fire Marshal Brent Halladay of newly appointed LP Gas Inspector, Boyd Cook, due to the retirement of Hugo Rico.
Presentation by State Fire Marshal Brent Halladay to Mr. Boyd Cook, recent chair of the Board, in recognition of his outstanding service over the past eight years on the board.
Presentation to the Board by Assistant Attorney General Lana Taylor of the annual requirement to inform the Board of any material changes to the Open and Public Meetings Act as required in UCA 52-4-9.
Presentation to the board by State Fire Marshal Brent Halladay on the disposition of Senate Bill 140 sponsored by Senator Curtis Bramble dealing with an exemption from requiring testing/certification as a filler/distributor and classifying a “person” as an “final consumer” (actual bill language is given below).
Presentation to the Board by State Fire Marshal Brent Halladay of the 2011 edition of NFPA 1192, Recreational Vehicle Standard, comments received, any amendments to that edition, and a motion to adopt if the Board so desires.
Request by Rich Maughan, Freeway Propane for an open discussion regarding liability insurance issues.
Presentation to the Board by Chief Deputy Coy Porter concerning the upcoming Board nominations and replacement needs. Two members will complete their two-term Board appointments on 30 June 2012.

(15) "Final consumer" means an individual or business who is the ultimate user of LPG.
Section 2. Section 53-7-308 is amended to read:53-7-308. Licenses and certificates.
A person may not engage in any of the following activities related to LPG unless [
he] the person has obtained an authorizing license or certification from the board:
(1) container activities[:], including the manufacture, assembly, repair, sale, installation, or subframing of containers for use in this state, except that a license is not required for the sale of new containers of 96 pounds water capacity or less;
(2) systems activities, including:(a) the installation, service, or repair of LPG systems for use in this state[
, including the]; and(b) laying or connecting of pipes and fittings connecting with or to systems or servicing a system and appliances to be used with LPG as a fuel;
(3) appliance activities[
:], including the service, installation, or repair of appliances used or to be used in this state in connection with systems using LPG as a fuel; or(4) product activities[
:], including the sale, transportation, dispensation, or storage of LPG in this state, except that a license or certification is not required [to sell LPG where the] for a person . [never obtains]:(a) who sells LPG but does not obtain possessory rights to the product sold; or [
where](b) when the product is [
transported or] stored, transferred, or used by the [ultimate] final consumer [for personal consumption only].
