
DUI Citation are used exclusively for incidents that involve Driving Under the Influence. Many people believe that DUI only involves persons who have been drinking alcohol. The truth is that alcohol is part of most DUI arrests, but there are other substances that can impair your driving. Illegal drugs such as marijuana, cocaine, and many others may be involved. Legal drugs such as prescriptions and even over the counter medications can cause impairment. Any substance that impairs your judgment can lead to major problems on our highways. When alcohol is involved there are three presumptive levels for the amount of alcohol in your system.
Most of the information on a DUI citation is identical to a regular citation.
There are several additional areas on the citation that you need to be aware of; In this example you can see that the code type as been entered as "DUI." Even the violations that would be coded differently on a regular citation are now DUI.
You will notice that the "Alcohol BAC" (Breath Alcohol Content) box now has an entry. In this example blood was drawn from the violator to identify the drugs in their system. This box may or may not have an entry.
On the bottom of the citation there are four check boxes that relate to the "Notice Of Intent To Deny, Suspend, Revoke, Or Disqualify." They refer to the three presumptive levels described above and with those who refuse to submit to a to a test to determine the amount of drugs or alcohol in their system.
Below those check boxes is a paragraph titled "Right To Hearing." You have a right to a hearing before the suspension / revocation of your license. Read this area carefully and contact Driver License to schedule the hearing. You can go to Driver License Office Locations to find the nearest Driver License office that holds hearings.
The last area of the citation specifies whether your copy of the citation is or is not a "Valid Temporary" driver license. State law requires the trooper to take your driver license and send it to the Driver License Division. If the "Valid" box is checked your copy of the citation is a valid driver license for 30 days and must be carried with you when you drive.
